1. Type of Personal Data We Collect

1.1. When Data is Collected

When You use Our Platform, We may collect Personal Data from or about You. In particular, We collect information You provide when You:

  2. register to use the Platform, including the Personal Data (as defined below);

For individuals: first name and last name, username/nickname, mobile number, e-mail address, gender, profile picture, Emirates ID, birthday information, nationality, resume, and interests.

For businesses: trade license information, e-mail address, physical address, and Emirates ID of the manager or such other document for identity verification and other purposes.

As part of Our commitment to transparency, Ayshei keeps records of all Service history, including completed Services, cancelled Services, active Services, and upcoming scheduled Services. Service details may include, but are not limited to, the following categories: electronics, motors, properties, home and garden, lifestyle, entertainment, art and collectibles, business and industrial, and jobs and services.

Moreover, in order to improve Your online experience at Ayshei, We have implemented impression reporting. While You view Our Services, and navigate our Platform, We gather Global Unique Identifier (GUI), HTTP request data like, user agent, IP, host, URL, country/continent from which the request is made, browser info, device/operating system/operating system version.

1.3. Financial Data

We do not collect any information related to Your Credit or Debit card details or any cryptocurrency payment method. Card payments are handled by Stripe and Crypto payments are handled by Total Processing (“Payment Gateway”). Both are leading payment gateways that adhere to industry standards for payment processing. 2. Cookies and Similar Technologies

  1. A browser cookie (“Cookies”) is a small piece of data that is stored on Your device to help websites remember things about You.   6. Publicly available information. When You post an item for sale or rent using our Services, you may choose to make certain personal information visible to other Ayshei Users. This may include your first name, last name, email address, location, and contact number. Please be aware that any personal information You publicly disclose on Our Platform may be visible to other Users and could potentially be shared with third parties. While We make reasonable efforts to ensure the privacy and security of Your personal information, We cannot guarantee the actions of other Users.   7. Advertising and analytics providers. In order to improve Our Services, We will sometimes share Your non-identifiable information with analytics providers that help Us analyze how Users are using our Platform. We share Your information with them in a non-identifiable form for monitoring and reporting the effectiveness of the campaign delivery to Our business partners and for internal business analysis.
  8. Ayshei. We may share Your information (i) in order to enhance and optimize Our Services on the Platform by collecting analytics and metrics to better understand Your behavior, Your preferences, and interests. This includes tracking Your activity on the Platform, such as the amount of time You spend on the Platform and how You use it. By analyzing this information, We are able to make suggestions and recommendations about Services that may be of interest to You. Rest assured that any data collected is handled in accordance with Our Privacy Policy and applicable laws and regulations, (ii) with regard to all credit/debit cards details and personally identifiable information, this information will not be stored, sold, shared, rented, or leased to any third parties. Services Providers will not have access to any debit/credit card details. Ayshei follows the industry’s standards to protect Your details during transmission and once received, but You should be aware that no method of electronic transmission or storage is 100% secure. We can therefore not be held responsible for the unlikely circumstances where information is accessed without authorization. Ayshei is connected to Payment Gateway as per the Terms posted on Our Platform; and (iii) for the purpose of enhancing Your experience on Our Platform, such as displaying advertisements relevant to Your location. We strive to personalize Our Services using this information, as well as collect anonymous and aggregated statistics about the characteristics and behavior of Our Platform. Additionally, We monitor Your interaction with third-party ad banners placed on Our Platform to evaluate and improve their effectiveness.

5. Storage and Processing

We will retain Your information in accordance with Our internal records retention and management policies and procedures, including as necessary to provide You with the Platform or administer Your Ayshei account, or as long as necessary to comply with Our legal obligations, resolve disputes, reserve Our legal rights, or enforce Our agreements.

We are committed to using Your Personal Data only for the specific purposes We collected it unless We determine that We have a legitimate reason for using it for a different purpose that is compatible with the original purpose. If We need to use Your Personal Data for an unrelated purpose, We will notify You and explain the legal basis for doing so. In some cases, We may process Your Personal Data without Your knowledge or consent if it is required or permitted by law, but We will always do so in compliance with applicable laws and regulations. If You have any questions or concerns about Our use of Your Personal Data, please don't hesitate to contact Us.

We aim to collect only what We need, keep it up-to-date, and remove it when We no longer need it.

We take reasonable steps to ensure that the Personal Data We process is (i) limited to what We require in connection with the purposes set out in this Privacy Policy, (ii) accurate, (iii) where necessary, kept up to date, and (iv) is erased or rectified without delay if it is inaccurate. From time to time, We may ask You to confirm the accuracy of Your Personal Data.

To the fullest extent permitted by law, Ayshei, any of its Group Company, or Service Providers may transfer information that We collect about You, including Personal Data across Services and from Your country or jurisdiction to other countries or jurisdictions around the world.

We use commercially reasonable safeguards to help keep the information collected through the Platform secure and take reasonable steps (such as requesting a unique password to verify Your identity before granting You access to Your account). However, Ayshei cannot ensure the security of any information You transmit or otherwise guarantee that information on the Platform may not be accessed, disclosed, altered, or destroyed.

We will retain copies in a form that permits identification for as long as We deem necessary in connection with the purposes set out in this Privacy Policy unless applicable laws require a longer retention period. In particular, We will retain Personal Data for as long as it is needed to establish, exercise or defend any legal rights.

You are responsible for maintaining the secrecy of Your unique password and account information, and for controlling access to emails between You and Ayshei, at all times.

6. Your Rights

As a data subject, You are entitled to exercise the following rights, at any time:

  1. Right to be informed. To be informed about how Your Personal Data is collected and processed and, its purposes.
  2. Right of Access. To obtain confirmation as to the existence of Your Personal Data being processed by Ayshei Platform, access and obtain a copy of such data.
  3. Right of rectification. To request to update, modify or rectify Your Personal Data where it may be inaccurate or incomplete.
  4. Right of Erasure. To obtain the erasure of Your Personal Data where You feel that the processing is unnecessary or otherwise unlawful, render Personal Data anonymous, block data whose processing is unlawful, or set limits to the processing provided Our legitimate interest to hold such information.
  5. Right to object.
  • Object to the processing of Your Personal Data, based on relevant grounds related to Your particular situation, which You believe must prevent Us from processing Your Personal Data for a given purpose.
  • Object to processing of Personal Data that is made for the purposes of sending advertising material, carrying out direct sales, market research, or commercial communication.
  • Object to automated decision-making. You can object to decisions made about You based on automated means. You have also the right to obtain human intervention to review decisions made which were based on automated processing

f. Right to restriction of the processing. Where You feel that the Personal Data processed is inaccurate, or that the processing is unnecessary or unlawful, as well as where You have objected to the processing.

g. Right to withdraw Your consent to processing (for Marketing and Profiling). Where your consent serves as the legal basis for processing – this will not affect the lawfulness of the processing carried out prior to Your withdrawal.

h. Right of portability. You have the right to obtain a copy of the Personal Data you provided to You through Our Platform.

We strive to ensure that the personal information You provide on Our platform is accurate and up to date. You may access and update Your personal information, including Your user profile, at any time. We encourage You to review Your personal information regularly and make any necessary updates to ensure its accuracy and completeness.

We take data privacy and protection seriously and have appointed a dedicated Data Protection Officer (DPO) to oversee our compliance with data protection regulations and address any questions or concerns You may have. Under UAE law, the DPO is responsible for ensuring that We process Your personal data in a lawful, fair, and transparent manner and that Your privacy rights are protected. 7. Data Deletion

We respect Your right to privacy and are committed to ensuring that Your Personal Data is processed lawfully, fairly, and transparently. If You wish to delete Your Personal Data, please send an email to Support. While We will make every effort to comply with such requests, please note that there may be circumstances where We cannot delete Your Personal Data due to legal, regulatory, or compliance requirements. In such cases, We may not be able to provide an explanation as to why We cannot delete such data due to confidentiality obligations.

To ensure that We delete the correct Personal Data, We may require proof of Your identity before deleting any information. We reserve the right to refuse the deletion of Your identity cannot be established or if We have a legitimate reason for retaining the data. We will notify you if we cannot comply with Your request to delete Your Personal Data, explaining the reasons why.

Under UAE law, We are required to retain certain types of Personal Data for a minimum period of time. If We cannot delete Your Personal Data due to legal, regulatory, or compliance requirements, We will inform You of the reasons why We must retain the data, and for how long.

Please note that certain features of Our Platform may require that You accept ‘app push notifications’ or alerts from our Service Providers. If You do not wish to receive these push notifications or alerts, You must withdraw Your consent for providing push notifications or alerts or using such features, in addition to adjusting the notifications on Your mobile device.

We take Your privacy seriously and will only use Your Personal Data to provide You with the Services You have requested. We will not share Your personal data with third parties for marketing purposes without your explicit consent, except as otherwise mentioned in this Privacy Policy.

9. Email Marketing

We offer electronic newsletters to which You may voluntarily subscribe at any time. We are committed to keeping Your e-mail address confidential and will not disclose Your email address to any third parties except as allowed in the storage and processing or for the purposes of utilizing a third-party provider to send such emails. We will maintain the information sent via e-mail in accordance with applicable laws and regulations.

All e-mails sent from Us will clearly state who the e-mail is from and provide clear information on how to contact the sender. You may choose to stop receiving Our newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting Us. However, You will continue to receive essential transactional emails.

To stay informed, We strongly recommend You keep Your Email notifications activated. You can choose to stop being sent an email notification but please be aware that if You have placed an order or are expecting a response to a message You have sent, You will need to actively check Your account for messages.

10. Security Measures

We have implemented and will maintain appropriate technical and organizational measures to safeguard the Personal Data that We control from unauthorized or unlawful processing, accidental loss, destruction, damage, alteration, or disclosure. We will promptly notify You and any applicable supervisory authority of any data security breach in compliance with Our legal obligations.

11. Payments Details

In case of Services requiring payment, We accept cryptocurrency payments or credit/debit cards used solely for processing payments. Your purchase transaction data is stored only as long as is necessary to complete Your purchase transaction. After that is complete, Your purchase transaction information is deleted. All data related to payment is stored by third-party service providers, namely Stripe as a payment gateway and Total Processing as a cryptocurrency payment gateway, in accordance with their respective privacy policies. Where necessary for processing future payments and subject to Your prior consent, Your financial information will be stored in encrypted form on secure servers of Our Payment Gateway service providers, who are beholden to treating Your Personal Data in accordance with their Privacy Policy, which we encourage You to review. Most direct payment gateways adhere to the latest security standards as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover.

12. Children Privacy

Ayshei is fully committed to complying with all applicable laws and regulations related to the protection of minors. As such, we expressly state that We do not knowingly collect or solicit any information from anyone under the age of 18, nor do We allow such persons to register and use the Platform. It is the sole responsibility of any individual under the age of 18 to obtain the express consent of their parents or legal guardians prior to accessing or using the Platform. We strongly recommend that parents or legal guardians supervise minors while they access or use the Platform. In the event that We discover that Personal Data has been collected from an individual under the age of 18 without parental or legal guardian consent, We will take immediate steps to remove the information from Our servers.

We are not responsible for the practices employed by any websites or services linked to or from Our Platform, including the information or content contained within them.
